Abstract Background: As most know visas have always been a very controversial topic in the United States, maybe not all have been exposed to the topic of visas as others have been. There are many types of visas that could be applied but for this research, the one is research in H-1b visas which are temporary visas that allow employers to petition for highly educated foreign professionals to work in "specialty occupations'' that require at least a bachelor's degree or the equivalent. Objective: This study aims to dissect the reason why H-1b visas are being denied and have been denied throughout the years and who is capable of receiving one. Design and Method: This research is based on scholarly articles found in the school database and includes a wide variety of sources that can be dated back to the 2000s when the H-1b visa program was fairly new and has been put in place not too long ago. To sources that are a few years old to see where we are now with the H-1b visa situation and with the newer information have some idea to where it might lead next. Results: This study brings out and puts together a few different puzzles that were not seen usually when researching about H-1b visas, that there is more to just an application being filled out, it needs to be so precisely accurate and every detail possible included to be even considered to be looked at because if one minor thing is off or even missing it won't be looked at and the applicant will be denied immediately. Conclusions: As of this moment, the topic of visas is a bit unstable and we really don't have an idea of what the future hold for certain surrounding this topic but what can definitely be taken from this study is that there is a light at the end of the tunnel for recipients of the H-1b visa that it seems to be taking a positive turn towards an increase of quotas being provided to be able to fulfill and accept more candidates.
